1. Definition of tenant and landlord
- The landlord refers to Boutique Hotel Guesthouse Moncarapacho, with the following contact details:
- Maarten and Celina Schiphorst-Ongenae
- Sitio da Cabeca 373-T, 8700-068 Moncarapacho Portugal
- Casa de Campo License (applied for)
- The following terms apply to all bookings with the landlord, unless otherwise agreed in writing.
- The tenant refers to the person who made the booking as well as any co‑tenants.
2. Rental period
- The minimum rental period is 7 nights, unless otherwise agreed in writing.
3. Reservation and deposit
- Reservations can be made online or by email.
- The reservation is confirmed after the landlord's confirmation and receipt of a 50% deposit of the rental amount.
- The deposit must be received by the landlord within one week after the reservation request confirmation.
- By paying the deposit you accept our general and cancellation terms.
- The remaining balance must be received by the landlord no later than sixty days before arrival.
- For bookings within 60 days before the start of the rental period, the full amount must be paid in one go according to the payment term specified in Article 3.3.
- If payments are not made within the agreed timeframe, the landlord may consider the failure to meet the payment agreement as a cancellation, and no refund will be given.
4. Booking and personal data
- All persons staying with the landlord must be listed by the main tenant in the booking.
- For the mandatory SEF registration (= Portuguese immigration and border service), the tenant must provide the landlord with the following personal data per guest (= all guests, including minors to the extent they are not Portuguese citizens):
- Last name and first names
- Address details
- Phone number
- Email address
- Date of birth
- Sex
- Country of origin
- Nationality
- Identity document, type
- Identity document, number
- Identity document, date of issue
- Purpose of stay in Portugal
- Arrival and departure dates
- Number of persons
- or:
- Instead of providing the above information, the tenant must present a valid identification document for each guest upon arrival so that the landlord can ensure the mandatory SEF registration.
5. Arrival and departure times
- Our standard check‑in times are from 16:00 and check‑out before 10:00. In consultation and based on availability, earlier check‑in and/or later check‑out may be possible.
- For an earlier arrival from 13:00, a half‑night rate will be charged.
- For an earlier arrival before 13:00, a full‑night rate will be charged.
- For a later departure until 15:00, a half‑night rate will be charged.
- For a later departure after 15:00, a full‑night rate will be charged.
6. The rental amount
- The stated prices include water, electricity and Wi‑Fi.
- The use of bed and kitchen linens, bath linens, bathrobes and beach towels is included.
- The final cleaning is included
7. Cleaning
- Daily (on weekdays) your stay will be lightly refreshed during your absence.
- For stays longer than 1 week (and each following week), bedding, used towels and linens are replaced weekly.
- At departure, the tenant is expected to leave the apartment tidy (dishes done, oven, BBQ & wood stove cleaned, and waste/garbage removed), or ask for our hotel service if you wish to leave cleaning entirely to us.
8. Guests and pets
- The maximum occupancy per accommodation is two persons, except for Casa Pauline where additional space is available for 1 person.
- The accommodation is exclusively accessible to the tenant and other members of the travel party, provided these have been specified in advance by the tenant in the booking.
- In consultation and only with written confirmation (by email), the tenant may host guests from outside the accommodation during the day (until 22:00) in/on the terrace of the rented holiday house provided they do not cause nuisance to other tenants. Guests from outside the accommodation are expressly prohibited from using the common garden, the pool or a guest parking space.
- The tenant is responsible for the behavior and any nuisance caused by their guests.
- If the tenant and/or guests as referred to in 8.3 cause nuisance (at the landlord’s discretion), they may be denied access to the premises immediately.
- Pets are not allowed.
9. Smoking, barbecue and open fire
- Smoking in the apartments is prohibited. The tenant is only allowed to smoke on the terrace belonging to the apartment where the tenant stays. Smoking in the rest of the garden and around the pool is prohibited.
- The use of a (gas) barbecue is only allowed at spots designated by the landlord.
- Making an open fire is prohibited.
10. Assignment
- The tenant may transfer the booking, no later than three days before the start of the rental, to another tenant by notifying this via email to info@guesthouse-moncarapacho.com
- For processing the transfer, Boutique Guesthouse Moncarapacho will charge a €50.00 change fee.
- Amounts already paid will be regarded as paid by the acquiring party by Boutique Guesthouse Moncarapacho. The transferring and acquiring parties shall arrange this between themselves.
11. Liability
- During the stay, the tenant is liable for the apartment, furnishings and all items belonging to the rental. Any damage caused must be reported to the landlord immediately.
- It is not allowed to move furniture in the holiday houses.
- After departure, the landlord will inspect the tenant’s premises.
- If damage occurs, it may be charged to the tenant.
- The landlord is not liable for loss, theft and/or (personal) injury caused by or to tenants of Boutique Guesthouse Moncarapacho.
- The landlord is not liable for damage caused by natural disasters, catastrophes, nuclear incidents, attacks, strikes, violence, epidemics and other external factors.
- The landlord is not liable or responsible for damage, loss or changes resulting from factors beyond their control.
- Boutique Hotel Guesthouse Moncarapacho is a renovated old Portuguese house to modern standards. There are level differences (e.g., sloping terrain and steps) within and around the property, due to its location and original construction. The tenant is aware of this, and the landlord is not liable for damage incurred due to these site‑related conditions.
- It may happen that, despite Boutique Hotel Guesthouse Moncarapacho being in a quiet location with no direct neighbors, work such as (land) construction or other activities takes place in the surroundings. The landlord is not liable for any nuisance resulting from this.
- The landlord reserves the right to cancel a reservation at any time if circumstances beyond the landlord’s control force or cause it. The landlord is only obligated to refund the rental amount already paid by the tenant for the unused rental days.

- If the stay does not proceed as expected, the tenant must inform the landlord as soon as possible, and a joint and suitable solution will be sought.

14. Contact
- When the stay does not proceed properly, you have the right to submit a claim or complaint, within 5 days after the departure date, including all relevant evidence and a clear request for compensation or refund.
- The claim or complaint must be submitted by post.
- The processed claim, after investigation and assessment, will provide a written response within 10 days after receipt.
- Any compensation will be refunded at the earliest possible time within the first 90 days after receiving the request.
- Failure to refund within the first 90 days will result in the landlord returning the amount upon sending the payment receipt on the rental platform’s website.
- All communication, including but not limited to emails, text messages, and phone calls, will first be taken over and recorded by the landlord and will be kept by the landlord for the first 90 days.
