General and/or booking terms 2025-10
1. Definition of tenant and landlord
- Landlord refers to Boutique Guesthouse-Moncarapacho, with the following contact details:
- Maarten and Celina Schiphorst-Ongenae
- Caminho do Calico 373-T, 8700-068 Moncarapacho Portugal
- License Casa de Campo RNET 13422 valid until 05/07/2031
- These terms and conditions apply to all bookings with the landlord, unless otherwise agreed in writing.
- Tenant refers to the person who made the booking as well as any co-tenants.
2. Rental period
- The minimum rental period is 7 nights, unless otherwise agreed in writing.
3. Reserving and down payment
- Reservations can be made online or by email.
- The reservation is definitive after confirmation by the landlord and receipt of a down payment of 50% of the rental amount.
- The down payment must be received by the landlord within one week of the reservation request confirmation.
- By making the down payment, you accept our general and cancellation terms.
- The remaining rental amount must be received by the landlord no later than sixty days before arrival.
- For bookings made within 60 days of the start of the rental period, the full amount must be paid in one installment according to the payment deadline mentioned in article 3.3.
- If payments are not made within the agreed deadline, the landlord may consider the failure to comply with the payment agreement as a cancellation and no refund will be given.
4. Booking and personal data
- All persons staying with the landlord must be listed by the main tenant at the time of booking.
- For the mandatory SEF registration (= Portuguese immigration and border service), the tenant must provide the landlord with the following personal data per guest (= all guests, including minors who are not Portuguese citizens):
- Surname and given names
- Address details
- Phone number
- Email address
- Date of birth
- Gender
- Country of origin
- Nationality
- Identity document, type
- Identity document, number
- Identity document, issue date
- Purpose of stay in Portugal
- Date of arrival and departure
- Number of persons
- or:
- Instead of providing the above data, the tenant must present a valid identification document for each guest upon arrival so that the landlord can ensure the mandatory SEF registration.
5. Arrival and departure times
- Our standard changeover times are check-in from 4:00 p.m. and check-out before 10:00 a.m. An earlier check-in and/or later check-out is possible upon request and based on availability.
- For an early check-in from 1:00 p.m., a half-night rate will be charged.
- For an early check-in before 1:00 p.m., a full-night rate will be charged.
- For a late check-out until 3:00 p.m., a half-night rate will be charged.
- For a late check-out after 3:00 p.m., a full-night rate will be charged.
6. Rental amount
- The mentioned prices include water, electricity, and WiFi.
- The use of bed and kitchen linen, bath towels, bathrobes, pool towels, and beach towels is included.
- Intermediate and final cleaning are included.
7. Cleaning
- During the intermediate cleaning, your stay will be lightly cleaned. Used towels and kitchen linen will be replaced.
- For stays longer than 10 days, bed linen will be changed.
- Upon departure, it is expected that the tenant will leave the apartment clean (dishes done, oven, BBQ & wood stove cleaned, and waste/rubbish removed).
8. Guests and pets
- The maximum occupancy per accommodation is two persons, except for Casa Pauline where there is additional space for two small children.
- The accommodation is exclusively accessible to the tenant and other members of the travel party, provided they are indicated in advance by the tenant at the time of booking.
- Upon request and only with written confirmation (by email), the tenant may receive guests from outside the accommodation during the day (until 10:00 p.m.) on the terrace of the rented holiday home, provided they do not cause any nuisance to other tenants. It is expressly prohibited for guests from outside the accommodation to use the common garden, the swimming pool, or a guest parking space.
- The tenant is responsible for the behavior and any nuisance caused by their guests.
- If the tenant and/or guests of a tenant as referred to in 8.3 cause any nuisance (at the landlord's discretion), they may be denied access to the premises immediately.
- Pets are not allowed.
9. Smoking, barbecue, and open fire
- Smoking in the apartments is prohibited. The tenant is only allowed to smoke on the terrace belonging to the apartment where they are staying. Smoking in the rest of the garden and around the pool is prohibited.
- The use of a (gas) barbecue is only permitted in designated areas by the landlord.
- Open fires are prohibited.
10. Substitution
- The tenant can transfer the booking, no later than three days before the start of the rental period, to another tenant by sending an email to info@guesthouse-moncarapacho.com
- Boutique Guesthouse Moncarapacho will charge a processing fee of €50.00 for handling the transfer.
- Any amounts already paid will be considered by Boutique Guesthouse Moncarapacho as having been paid by the party taking over the booking. The transferring and taking-over parties must settle this between themselves.
11. Liability
- During the stay, the tenant is liable for the apartment, its furnishings, and all items belonging to the rental property. Any damage caused must be reported immediately to the landlord.
- It is not permitted to move furniture in the holiday homes.
- After departure, the landlord will inspect the tenant's apartment.
- If any damage occurs, it may be charged back to the tenant.
- The landlord is not liable for loss, theft, and/or (personal) injury suffered by or caused to tenants of Boutique Guesthouse-Moncarapacho.
- The landlord is not liable for damage caused by natural disasters, natural catastrophes, nuclear disasters, attacks, strikes, acts of violence, epidemics, and other external factors.
- The landlord is not liable or responsible for damage, loss, or changes resulting from factors beyond their control.
- Boutique Guesthouse-Moncarapacho is an old Portuguese house renovated to modern standards. There are differences in level (due to the sloping terrain and steps) inside and around the property, which result from its location and original construction. The tenant is aware of this and the landlord is not liable for any damage sustained due to these circumstances specific to the location.
- Despite Boutique Guesthouse-Moncarapacho's quiet location and lack of immediate neighbors, construction work or other activities may occasionally take place in the surrounding area. The landlord is not liable for any nuisance resulting from this.
- The landlord reserves the right to cancel a reservation at any time if circumstances beyond their control require or necessitate it. The landlord is only obligated to refund the already paid rental amount for the unused rental days.
12. Complaints
- If the stay does not meet expectations, the tenant should inform the landlord as soon as possible, and they will jointly seek an appropriate solution.
13. Swimming pool access
- Use is at the tenant's own risk.
- Children may only use the swimming pool under parental supervision.
- The swimming pool is unheated and therefore open from mid-April to October.
14. Guarantees
- The landlord guarantees that the holiday home is well-maintained at the start of the rental period and meets the tenant's expectations regarding a complete holiday home.
- The tenant guarantees that the house is used exclusively for vacation purposes. If it becomes apparent that the tenant has used the house for other purposes without the owner's knowledge, the owner is entitled to terminate the rental agreement immediately, subject to a fine of €10,000 and any resulting damage will be recovered from the respective tenant.
- The tenant guarantees that the house is only used by the tenant and co-tenants and is not sublet. The number of guests remains limited to the number indicated at the time of reservation. If this number is exceeded, the tenant is obligated to inform the owner.
15. Privacy
- The landlord is obliged to provide certain personal data of the tenant to the SEF (the public service overseeing borders and "foreigners," including tourists).
- Personal data will not be provided to third parties, except for:
- Hostnet BV, De Ruijterkade 6, 1013 AA Amsterdam for mail & web hosting;
- Mytourist BV, Peppelenbos 5d, 6662 WB Elst for booking platform and customer contact;
- Severina Lobo & Lobo, Lda. Estrada Nacional 125 Cx. P. 103-E 8800-118 Luz de Tavira, Portugal for accounting under Portuguese law and reporting to SEF.

16. Denial of access
- If it becomes apparent (at the landlord's discretion) that the tenant does not comply with the aforementioned conditions, the landlord reserves the right to deny the tenant access to Boutique Guesthouse-Moncarapacho immediately. This will be considered a cancellation, and no refund will be given.
17. Tourist tax
- We are required to collect tourist tax. The rates are as follows:
- €1.00 per person per night with a maximum of 5 nights from November to April
- €2.00 per person per night with a maximum of 5 nights from May to October
- Children under the age of 16 are exempt.
18. Agreement
- The tenant is deemed to have read and understood these and the aforementioned terms and conditions.
- By making a reservation, the tenant agrees to these and the aforementioned terms and conditions.
