General and/or booking conditions 2024-01

1 Definition of tenant and landlord
1.1 Guesthouse-Moncarapacho is a holiday accommodation, with the following contact details:

  1. Celina Schiphorst-Ongenae and Maarten Schiphorst
  2. Sitio da Cabeca 373-T, 8700-068 Moncarapacho Portugal
  3. License Casa de Campo (on request)

1.2 The following conditions apply to all bookings at Guesthouse-Moncarapacho, unless otherwise agreed in writing.
1.3 Tenant means the person who made the booking as well as any co-tenants.

2 Rental period
2.1 The minimum rental period is 7 nights, unless otherwise agreed in writing.

3 Reservations and deposit
3.1 Reservations can be made online or by e-mail.
3.2 The reservation will be confirmed by the landlord by e-mail.
3.3 The reservation is only final after confirmation by the landlord and after receipt of the deposit of 50% of the rental amount.
3.4 The deposit must be received by the landlord within one week after confirmation of the reservation request.
3.5 The remainder of the rent must be received by the landlord no later than thirty days before arrival.
3.6 If payments are not made within the agreed period, the landlord reserves the right to cancel the reservation.
3.7 In the event that a deposit has already been made, failure to comply with the payment agreement (see 3.3) will be regarded as cancellation and no refund will be made.

4 Booking and personal data
4.1 All persons staying with the landlord must be mentioned by the main tenant when booking.

5 Arrival and departure times
5.1 Arrival from 4:00 PM to 9:00 PM.
5.2 Departure before 10:30 am.
5.3 Deviations from the times mentioned are possible in consultation and based on availability.

6 The rental amount
6.1 The prices mentioned include water, electricity and WiFi.
6.2 The use of bed linen, bathroom and kitchen linen is included.
6.3 Final cleaning is included

7 Cleaning
7.1 Upon departure, the tenant is expected to leave the apartment tidy (dishes done, BBQ & wood stove cleaned and dirt removed), or ask for our hotel service rate if you want to leave tidying and cleaning entirely to us.7.2 For a longer stay then 1 week (and every subsequent week) the bed linen, used towels and used linen will be replaced weekly.
7.3 For a stay of longer than 1 week, additional (weekly) interim cleaning can be booked for €35 per time.

8 Guests and pets
8.1 The maximum occupancy per accommodation is two people, with the exception of Casa Pipa where there is additional space for 1 baby.
8.2 The accommodation is only accessible to the tenant and other members of the travel group, provided that they have been indicated in advance by the tenant when booking.
8.3 In consultation and only with written confirmation (by e-mail), the tenant may receive guests from outside the accommodation during the day (until 10:00 p.m.), provided they do not cause any nuisance to other tenants. The tenant is responsible for the behavior and any nuisance of his or her guests.
8.4 If the tenant and/or guests of a tenant as referred to in 7.4 cause a nuisance (at the discretion of the landlord), they can be immediately denied access to the site.
8.5 Pets are not allowed.
8.6 If it appears (at the landlord's discretion) that conditions 7.1 to 7.6 are not met, the landlord reserves the right to immediately deny the tenant access to Guesthouse-Moncarapacho. This will be considered a non-refundable cancellation.

9 Smoking, barbecue and open fire
9.1 Smoking in the apartments is prohibited. The tenant is only allowed to smoke on the terrace belonging to the apartment where the tenant is staying. Smoking in the garden is prohibited (due to the strict fire safety rules that apply in Portugal).
9.2 The use of a barbecue is only permitted in places designated by the landlord.
9.3 Making an open fire is prohibited.
9.4 If it appears (at the landlord's discretion) that conditions 8.1 to 8.3 are not met, the landlord reserves the right to immediately deny the tenant access to Guesthouse-Moncarapacho. This will be considered a non-refundable cancellation.

10 Replacement
10.1 The tenant can transfer the booking to another tenant no later than three days before the start of the rental. This is only possible with written permission from the landlord.

11 Liability
11.1 During the stay, the tenant is liable for the apartment, the furnishings and all items belonging to the rented property. Any damage caused must be reported to the landlord immediately.
11.2 If damage has occurred, this can be charged to the tenant.
11.3 The landlord is not liable for loss, theft and/or (personal) damage caused to or by tenants of Guesthouse-Moncarapacho.
11.4 The lessor is not liable for damage caused by natural disasters, natural disasters, nuclear disasters, attacks, strikes, acts of violence, epidemics and other external factors.
11.5 The lessor is not liable or responsible for damage, loss or changes resulting from factors beyond its control.
11.6 Guesthouse-Moncarapacho is an old Portuguese house renovated to modern standards. There are level differences (including sloping terrain, steps and steps) in and around the building, resulting from its location and the original construction. The tenant is aware of this and the landlord is not liable for damage incurred due to these circumstances associated with the location.
11.7 It may happen that, despite the fact that Guesthouse-Moncarapacho is quietly located and there are no immediate neighbors, work is taking place in the area, such as (agricultural) construction work or other activities. The landlord is not liable for any nuisance resulting from this.
11.8 The landlord has the right to cancel a reservation at any time if circumstances beyond the landlord's control force or necessitate this. The landlord is only obliged to refund the rental amount already paid by the tenant for the rental days not used.

12 Complaints
12.1 If the stay does not go according to expectations, the tenant must inform the landlord as soon as possible so that a solution can be sought.

13 Access to swimming pool
13.1 Use is at your own risk.

14 Privacy
14.1 The landlord is obliged to provide certain personal data of the tenant to the SEF (the public service that monitors borders and "foreigners", including tourists).
14.2 Personal data will not be provided to third parties, with the exception of our cooperation partner (MyTourist), for recording the necessary data for a reservation in the booking system and other processors as mentioned in the "Controllers & Processors" section of our "privacy statement" .

15 Denial of access
15.1 If it appears (at the landlord's discretion) that the tenant does not comply with the conditions described above, the landlord reserves the right to immediately deny the tenant access to Guesthouse-Moncarapacho. This will be considered a non-refundable cancellation.

16 Agreed
16.1 The tenant is deemed to have read and understood these and the above conditions. When booking, the tenant agrees to these and the above conditions.
