General and/or booking conditions 2024-10

1. Definition of tenant and landlord

  1. The landlord refers to Boutique Guesthouse Moncarapacho, with the following contact details:

  4. Casa de Campo License (pending)
  5. The following conditions apply to all bookings with the lessor, unless otherwise agreed in writing.
  6. The tenant refers to the person who made the booking and any co-tenants.

2. Rental period

  1. The minimum rental period is 7 nights, unless otherwise agreed in writing.

3. Reservations and deposits

  1. Reservations can be made online or by email.
  2. The reservation is final after confirmation by the landlord and after receipt of the deposit of 50% of the rental amount.
  3. The deposit must be received by the landlord within one week after confirmation of the reservation request.
  4. By paying the deposit you accept our general and cancellation terms and conditions.
  5. The remainder of the rental amount must be received by the landlord no later than sixty days prior to arrival.
  6. For bookings made within 60 days before the start of the rental period, the total amount must be paid in one go in accordance with the payment terms stated in Article 3.3.
  7. If payments are not made within the agreed period, the landlord may consider the failure to comply with the payment agreement as cancellation and no refund will be made.

4. Booking and personal data

  1. All persons staying with the landlord must be registered by the main tenant when booking.
  2. For the mandatory SEF registration (= Portuguese Immigration and Border Service), the tenant must provide the landlord with the following personal data per guest (= all guests, including minors if they are not Portuguese citizens):
    • Surname and first names
    • Address details
    • Phone number
    • Email address
    • Date of birth
    • Sex
    • Country of origin
    • Nationality
    • Identity document, type
    • Identity document number
    • Identity document, date of issue
    • Purpose of stay in Portugal
    • Date of arrival and departure
    • Number of persons

    • Upon arrival, the tenant must present a valid identification document for each guest so that the landlord can take care of the mandatory SEF registration.

5. Arrival and departure times

  1. Arrival from 4:00 PM to 9:00 PM.
  2. Please leave before 10:00 am.
  3. Deviations from the stated times are possible in consultation and based on availability.

6. The rental amount

  1. The prices quoted include water, electricity, use of charging stations for electric vehicles and WiFi.
  2. The use of bed and kitchen linen, bath linen, bathrobes and beach towels is included.
  3. Final cleaning is included

7. Cleaning

  1. Upon departure, the tenant is expected to leave the apartment tidy (dishes done, oven, BBQ & wood stove cleaned and rubbish/garbage removed). Alternatively, ask about our hotel service if you would like to leave the tidying and cleaning entirely to us.
  2. For stays longer than 1 week (and each subsequent week), bed linen, used towels and used linen will be changed weekly.
  3. For stays longer than 1 week, additional (weekly) interim cleaning can be booked for €35 per time.

8. Guests and pets

  1. The maximum occupancy per accommodation is two persons, with the exception of Casa Pauline where there is room for 1 additional person.
  2. The accommodation is only accessible to the tenant and other members of the travel group, provided that they have been indicated in advance by the tenant when booking.
  3. By prior arrangement and only with written confirmation (by email), the tenant may receive guests from outside the property on/in the terrace of the rented holiday home during the day (until 10:00 PM), provided they do not cause any nuisance to other tenants. It is strictly prohibited for guests from outside the property to use the communal garden, swimming pool, or guest parking.
  4. The tenant is responsible for the behavior and any nuisance caused by his or her guests.
  5. If the tenant and/or guests of a tenant as referred to in 8.3 cause a nuisance (at the landlord's discretion), they may be immediately denied access to the premises.
  6. Pets are not allowed.

9. Smoking, barbecue and open fire

  1. Smoking is prohibited in the apartments. Smoking is only permitted on the terrace of the apartment where the tenant is staying. Smoking is prohibited in the rest of the garden and around the pool.
  2. The use of a (gas) barbecue is only permitted in places designated by the landlord.
  3. Making open fires is prohibited.

10. Substitution

  1. The tenant can transfer the booking to another tenant no later than three days before the start of the rental by notifying this by email to info@guesthouse-moncarapacho.com
  2. For processing the transfer, Boutique Guesthouse Moncarapacho will charge a €50.00 change fee.
  3. Boutique Guesthouse Moncarapacho will consider amounts already paid as paid by the acquiring party. The transferring and acquiring parties must further settle this matter among themselves.

11. Liability

  1. During the stay, the tenant is responsible for the apartment, its furnishings, and all items belonging to the rental property. Any damage must be reported to the landlord immediately.
  2. It is not permitted to move furniture in the holiday homes.
  3. After departure, the tenant's home will be inspected by the landlord.
  4. If any damage has occurred, this can be charged to the tenant.
  5. The landlord is not liable for loss, theft and/or damage (including personal injury) caused to or by tenants of Boutique Guesthouse Moncarapacho.
  6. The lessor is not liable for damage caused by natural disasters, nuclear disasters, attacks, strikes, acts of violence, epidemics and other external factors.
  7. The landlord is not liable or responsible for any damage, loss or changes resulting from factors beyond its control.
  8. Boutique Guesthouse Moncarapacho is a traditional Portuguese house renovated to modern standards. There are some differences in level (including sloping terrain and steps) in and around the property, resulting from its location and original construction. The tenant is aware of this, and the landlord is not liable for any damage incurred due to these circumstances.
  9. Despite Boutique Guesthouse Moncarapacho's quiet location and lack of immediate neighbors, construction work, agricultural work, or other activities may be taking place nearby. The landlord is not liable for any resulting nuisance.
  10. The landlord reserves the right to cancel a reservation at any time if circumstances beyond the landlord's control necessitate or require this. The landlord is only obligated to refund the rent already paid by the tenant for the unused rental days.

12. Complaints

  1. If the stay does not go as expected, the tenant must inform the landlord as soon as possible and a mutually agreed-upon solution will be sought.

13. Swimming pool access

  1. Use is at the tenant's own risk.
  2. Children may only use the swimming pool under parental supervision.
  3. The pool is not heated continuously and remains open as long as weather conditions permit.

14. Guarantees

  1. The landlord guarantees that the holiday home is well maintained at the start of the rental period and meets the tenant's expectations for a complete holiday home.
  2. The tenant guarantees that the house will be used exclusively for vacation purposes. If it turns out that the tenant has used the house for purposes other than vacation without the owner's knowledge, the owner is entitled to terminate the rental agreement immediately, subject to a €10,000 fine, and any resulting damages will be recovered from the tenant in question.
  3. The tenant guarantees that the house will be used solely by the tenant and co-tenant(s) and will not be sublet. The number of guests is limited to the number of people specified in the reservation. If this number is exceeded, the tenant is obligated to notify the owner.

15. Privacy

  1. The landlord is obliged to provide certain personal data of the tenant to the SEF (the public service that monitors borders and "foreigners", including tourists).
  2. Personal data will not be provided to third parties, with the exception of:
    • Hostnet BV, De Ruijterkade 6, 1013 AA Amsterdam for mail & web hosting;
    • Mytourist BV, Peppelenbos 5d, 6662 WB Elst for booking platform and customer contact;
    • Severina Lobo & Lobo, Lda. Estrada Nacional 125 Cx. P. 103-E 8800-118 Luz de Tavira, Portugal for accounting under Portuguese law and reporting to SEF.
    • which are named as processors in the "Controllers & Processors" section of our "privacy statement".

16. Denial of access

  1. If it appears (at the landlord's discretion) that the tenant does not comply with the conditions described above, the landlord reserves the right to immediately deny the tenant access to Boutique Guesthouse Moncarapacho. This will be considered a cancellation and no refund will be made.

17. Tourist tax

  1. We are required to collect tourist tax. The rates are as follows:
  2. €1.00 pppn with a maximum of 5 nights between November and April
  3. €2.00 pppn with a maximum of 5 nights between May and October
  4. Children under 16 are exempt.

18. Agreement

  1. The tenant is deemed to have read and understood these and the above-mentioned conditions.
  2. When booking, the tenant agrees to these and the above conditions.
