General and/or booking conditions 2024-10
1. Definition of tenant and landlord
- The landlord refers to Boutique Guesthouse Moncarapacho, with the following contact details:
- Maarten and Celina Schiphorst-Ongenae
- Sitio da Cabeca 373-T, 8700-068 Moncarapacho Portugal
- License Casa de Campo (pending)
- The following conditions apply to all bookings with the lessor, unless otherwise agreed in writing.
- Tenant means the person who made the booking as well as any co-tenants.
2. Rental period
- From April 15 to October 15, the minimum rental period is 1 night for Casa Pauline and Casa Florine, unless otherwise agreed in writing.
- From October 15 to April 15, the minimum rental period is 28 nights for Casa Pauline and Casa Florine, unless otherwise agreed in writing.
- The minimum rental period for Casa Celine is 3 nights, unless otherwise agreed in writing.
3. Reservations and deposits
- Reservations can be made online or by email.
- The reservation is final after confirmation by the landlord and after receipt of the deposit of 50% of the rental amount.
- The deposit must be received by the landlord within one week after confirmation of the reservation request.
- By paying the deposit you accept our general and cancellation conditions.
- The remainder of the rental amount must be received by the landlord no later than sixty days before arrival.
- For bookings made within 60 days before the start of the rental period, the total amount must be paid in one go in accordance with the payment term stated in Article 3.3.
- If payments are not made within the agreed term, the landlord may consider failure to meet the payment agreement as cancellation and no refund will be made.
4. Booking and personal data
- All persons staying with the landlord must be stated by the main tenant when booking.
- For the purpose of the mandatory SEF registration (= Portuguese Immigration and Border Service), the tenant must provide the landlord with the following personal data per guest (= all guests, including minors if they are not Portuguese citizens):
- Surname and first names
- Address details
- Phone number
- Email address
- Date of birth
- Sex
- Country of origin
- Nationality
- Identity document, type
- Identity document, number
- Identity document, date of issue
- Purpose of stay in Portugal
- Date of arrival and departure
- Number of persons
- Upon arrival, the tenant must present a valid identification document for each guest so that the landlord can take care of the mandatory SEF registration.
5. Arrival and departure times
- Arrival from 4:00 PM to 9:00 PM.
- Departure before 10:00 am.
- Deviations from the stated times are possible in consultation and based on availability.
6. The rental amount
- The prices quoted include water, electricity, use of charging stations for electric vehicles and WiFi.
- The use of bed and kitchen linen, bath linen, bathrobes and beach towels is included.
- Final cleaning is included
7. Cleaning
- Upon departure, the tenant is expected to leave the apartment tidy (dishes done, oven, BBQ & wood stove cleaned and rubbish/garbage removed), or ask for our hotel service if you would like to leave the tidying and cleaning entirely to us.
- For stays longer than 1 week (and every week thereafter), bed linen, used towels and used linen will be changed weekly.
- For stays longer than 1 week, additional (weekly) interim cleaning can be booked for €35 per time.
8. Guests and pets
- The maximum occupancy per accommodation is two persons, with the exception of Casa Pipa where there is room for 1 additional person.
- The accommodation is only accessible to the tenant and other members of the travel group, provided that they have been indicated in advance by the tenant when booking.
- In consultation and only with written confirmation (by e-mail), the tenant may receive guests from outside the accommodation during the day (until 22:00) in/on the terrace of the rented holiday home, provided that they do not cause any inconvenience to other tenants. It is expressly not permitted for guests from outside the accommodation to use the communal garden, the swimming pool or a guest parking space.
- The tenant is responsible for the behavior and any nuisance caused by his or her guests.
- If the tenant and/or guests of a tenant as referred to in 8.3 cause a nuisance (at the discretion of the landlord), they may be immediately denied access to the premises.
- Pets are not allowed.
9. Smoking, barbecue and open fire
- Smoking is prohibited in the apartments. The tenant is only allowed to smoke on the terrace belonging to the apartment where the tenant is staying. Smoking is prohibited in the rest of the garden and around the pool.
- The use of a (gas) barbecue is only permitted in places designated by the landlord.
- Making open fires is prohibited.
10. Substitution
- The tenant can transfer the booking to another tenant no later than three days before the start of the rental by reporting this by email to info@guesthouse-moncarapacho.com
- For processing the transfer, Boutique Guesthouse Moncarapacho will charge a change fee of Euro 50.00.
- Amounts already paid will be considered by Boutique Guesthouse Moncarapacho as having been paid by the acquiring party. The transferring and acquiring parties must further arrange this among themselves.
11. Liability
- During the stay, the tenant is liable for the apartment, the furnishings and all items belonging to the rented property. Any damage caused must be reported to the landlord immediately.
- It is not permitted to move furniture in the holiday homes.
- After departure, the tenant's home will be inspected by the landlord.
- If any damage has occurred, this can be charged to the tenant.
- The landlord is not liable for loss, theft and/or (injury) damage caused to or by tenants of Boutique Guesthouse Moncarapacho.
- The lessor is not liable for damage caused by natural disasters, natural disasters, nuclear disasters, attacks, strikes, acts of violence, epidemics and other external factors.
- Lessor is not liable or responsible for any damage, loss or changes resulting from factors beyond its control.
- Boutique Guesthouse Moncarapacho is an old Portuguese house renovated to modern standards. There are differences in level (including sloping terrain and steps) in and around the building, resulting from the location and the original construction. The tenant is aware of this and the landlord is not liable for damage incurred by these circumstances belonging to the location.
- It may happen that, despite the fact that Boutique Guesthouse Moncarapacho is quietly situated and has no direct neighbours, there are activities taking place in the area such as (agricultural) construction or other activities. The landlord is not liable for any nuisance resulting from this.
- The lessor has the right to cancel a reservation at any time if circumstances beyond the lessor's control force or necessitate this. The lessor is only obliged to refund the rent already paid by the tenant for the rental days not used.
12. Complaints
- If the stay does not go as expected, the tenant must inform the landlord as soon as possible and a joint and appropriate solution will be sought.
13. Swimming pool access
- Use is at the tenant's own risk.
- Children may only use the swimming pool under parental supervision.
- The pool is not heated continuously and remains open as long as weather conditions permit.
14. Guarantees
- The landlord guarantees that the holiday home is well maintained at the start of the rental and meets the tenant's expectations with regard to a complete holiday home.
- The tenant guarantees that the house will be used exclusively for holiday purposes. If it appears that the tenant has used the house - without the owner's knowledge - for purposes other than holiday, the owner is entitled to terminate the rental agreement immediately, under penalty of a fine of € 10,000, and any damage resulting from this will be recovered from the tenant in question.
- The tenant guarantees that the house is only used by the tenant and co-tenant(s) and is not sublet. The number of guests remains limited to the number of persons stated in the reservation. If this number is exceeded, the tenant is obliged to report this to the owner.
15. Privacy
- The landlord is obliged to provide certain personal data of the tenant to the SEF (the public service that monitors borders and “foreigners”, including tourists).
- Personal data will not be provided to third parties, with the exception of:
- Hostnet BV, De Ruijterkade 6, 1013 AA Amsterdam for mail & web hosting;
- Mytourist BV, Peppelenbos 5d, 6662 WB Elst for booking platform and customer contact;
- Severina Lobo & Lobo, Lda. Estrada Nacional 125 Cx. P. 103-E 8800-118 Luz de Tavira, Portugal for accounting under Portuguese law and reporting to SEF.
- which are named as processors in the section "Controllers & Processors" of our "privacy statement".
16. Denial of access
- If it appears (at the discretion of the landlord) that the tenant does not meet the conditions described above, the landlord reserves the right to deny the tenant access to Boutique Guesthouse Moncarapacho with immediate effect. This will be considered a cancellation with no refund.
17. Tourist tax
- We are required to collect tourist tax. The rates are as follows:
- €1.00 pppn with a maximum of 5 nights between November and April
- €2.00 pppn with a maximum of 5 nights between May and October
- Children under 16 are exempt.
18. Agreement
- The tenant is deemed to have read and understood these and the above-mentioned conditions.
- When booking, the tenant agrees to these and the above conditions.
